Commercial Electronic Message Clarification Text
1. PURPOSE
Pursuant to Article 10 of the Personal Data Protection Law No. 6698 ("PDPA"), BİLETİNİAL BİLET BASIM VE DAĞITIM ANONİM ŞİRKETİ ("Data Controller", "Company") has the obligation to inform the persons (in other words, the relevant persons) with whom commercial communication will be established and commercial electronic messages will be sent (in other words, the relevant persons) about the processing processes of the personal data of the relevant person, transfer to third parties, collection methods, legal reasons and their rights under Article 11 of the PDPA.
With this Clarification Text, you will be informed about the above issues.
2. SCOPE
The Clarification Text covers the information for the persons to whom commercial communication will be established and commercial electronic messages will be sent.
3. DEFINITIONS AND GENERAL INFORMATION
PDPA refers to the Law No. 6698 on the Protection of Personal Data.
Personal data refers to any information belonging to an identified or identifiable natural person. In this context, all information that identifies the person such as name, surname, telephone number, e-mail address is personal data.
Commercial electronic message; It refers to messages containing data, audio and video content sent for commercial purposes and sent electronically using means such as telephone, call centers, fax, automatic dialing machines, smart voice recorder systems, electronic mail, short message service.
Commercial electronic message management system (CEMS) refers to the system that allows obtaining commercial electronic message approval, exercising the right to refuse and managing complaint processes.
Commercial communication refers to all kinds of communication related to electronic commerce in order to gain profit within the scope of professional or commercial activity, except domain names and e-mail addresses.
Processing of personal data refers to all kinds of operations performed on data such as obtaining, examining, recording and using such information. For example, sending SMS to the relevant persons for purposes such as advertising, campaign, promotion, promotion is a data processing.
Data Controller refers to the natural or legal person who determines the purposes and means of processing personal personal data and is responsible for the establishment and management of the data recording system. Our company is registered in the Data Controllers Registry Information System under the name "BİLETİNİAL BİLET BASIM VE DAĞITIM ANONİM ŞİRKETİ".
Data subject refers to the real person whose personal data is processed.
4. CLARIFICATION TEXT
4.1. For what purposes will your personal data be processed and to whom and for what purposes will it be transferred?
In commercial communication and commercial electronic messages;
- Your identity information (Name, surname)
- Your contact information (phone number, e-mail address)
- Your transaction security information (Your transaction information and verification code for your commercial electronic message preference)
- Your marketing information (shopping history, information obtained through campaigns)
It will be processed for the purpose of carrying out advertising, campaign, promotion or promotion processes.
The transfer details of your personal data that we process are as follows:
- Transfer to e-mail servers and message centers in order to ensure business continuity.
- In order to ensure information security (verification), it is transferred to third parties from whom support is received.
- It is transferred to the third party supported, IYS and authorized institutions (such as the Ministry of Commerce) in order to enter and exit the message management system and keep records.
- In the event that there is a need to establish a legal transaction (such as filing a lawsuit, making a defense, requesting information/documents from official authorities), transfers may be made to authorized public institutions and organizations (such as courts, prosecutor's offices, authorities) and private law persons operating in the field of law (such as lawyers, mediators) in order to follow and carry out legal affairs.
- In order to carry out the request or complaint process and depending on the request or complaint, it may be transferred to you or other third parties you authorize or other third parties necessary for the resolution of the request/complaint.
Since the receipt of contact information also requires verification of this information; a link or verification code will be sent to your e-mail address or mobile phone number you have specified; to confirm the sending of commercial electronic messages and to ensure transaction security. Therefore, the transfer will be made to the contact addresses you have specified and to your service provider. (If the server of your e-mail address you have specified is abroad, then personal data will be transferred abroad. If you do not consent to the transfer of personal data abroad, please make sure that the servers of your e-mail address are located in Turkey).
After submitting your contact information, you can give your consent for commercial communication and commercial electronic messages by using the verification code received by you (or by telling our officer). If you consent to commercial communication and electronic messages, you will be consenting to sending you SMS or e-mail for marketing, campaign, promotion and promotional purposes. You may withdraw your consent at any time and without giving any reason and terminate the data processing subject to your consent.
4.2. How is your personal data collected?
Your personal data are obtained verbally or electronically through our internet address biletinial.com by your specifying this information to us, your movements on the website, your preferences and verification codes that you have specified to our bench / box office attendant.
4.3. What is the Legal Reason for Collecting Your Personal Data?
Your transaction security information is collected within the scope of the legal reason for data processing stated in Article 5/2-f of the PDPA, "provided that it does not harm the fundamental rights and freedoms of the data subject, it is mandatory to process data for the legitimate interests of the data controller".
Your personal data other than transaction security is processed with your explicit consent as stated in Article 5/1 of the PDPA.
If you have provided your electronic contact address during the commercial communication and commercial electronic message processes; If you have provided your electronic contact address during the transactions regarding the procurement of products / services from our company before 01.05.2015, commercial communications considered within this scope will be processed within the legal reason of "expressly stipulated in the laws" and "explicit consent", since this contact information is deemed approved in accordance with Provisional Article 1 (2) of the Regulation on Commercial Communication and Commercial Electronic Messages.
Giving permission for commercial electronic messages is entirely at the request of the person concerned, and not giving permission for messages does not result in not benefiting from our services. You can also benefit from our services without giving permission for commercial electronic messages.
E-bulletin transactions, sending SMS, sending e-mails are considered within the scope of commercial electronic message activity.
On the other hand, the processing of your personal data for the purpose of following up and carrying out legal affairs is carried out within the scope of the data processing legal grounds listed in the PDPA article 5/2-a, which states "clearly stipulated in laws", 5/2-ç, which states "it is necessary for the data controller to fulfill its legal obligation", 5/2-e, which states "it is necessary to process data for the establishment, use or protection of a right", and 5/2-f, which states "it is necessary to process data for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the relevant person"
4.4. What are your rights as a data subject?
Your rights as a data subject are listed in Article 11 of the PDPA. You can communicate these rights to us in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller.
